Terms of Use
Effective date: 11 September 2026
These terms are the agreement between you and Flexfit Softwareentwicklung, Inhaber: Américo Andrés Munoz Buschmann ("CLYMB", "we", "us") for use of the CLYMB website and app. By creating an account you accept them.
1. What CLYMB is
CLYMB is a fitness product that generates adaptive climbing-conditioning and skills training plans. It is free and currently in beta: features may change, and the service may occasionally be unavailable.
2. Not medical advice
CLYMB is not a medical device and provides no medical advice, diagnosis or treatment. Training carries risk of injury. You train at your own risk and are responsible for judging whether an exercise is safe for you. Consult a qualified professional before starting, especially if you are injured, pregnant, or have a medical condition. Stop immediately if you feel pain.
3. Your account
You must be at least 16 in the EEA and the UK (or 13, where your country's law allows it with parental consent), and at least 13 elsewhere. Keep your credentials secure, give us accurate information, and use one account per person. You are responsible for what happens under your account.
4. Acceptable use
Do not use CLYMB to break the law, to attack, overload, scrape or reverse-engineer the service, to access another person's account or data, or to resell or redistribute the service. We may suspend or close an account that does.
5. Your content and data
Your training data is yours. You grant us only the licence we need to run the service for you: store it, process it and show it back to you. How we handle it is set out in our Privacy Policy.
6. Our content
The app, the site, the training programmes, the exercise library, the animations and the CLYMB name and logo are ours and are protected by copyright and trade-mark law. You get a personal, non-transferable, revocable licence to use them for your own training, and nothing more.
7. Ending the agreement
You can delete your account at any time in the app (Profile → Delete account) or via our account-deletion page; that ends this agreement and erases your data. We may suspend or terminate access if you materially breach these terms, and we will tell you why unless the law prevents us.
8. Liability
CLYMB is provided "as is" and we do not warrant that it will be uninterrupted or error-free. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited, and if you are a consumer in the EEA or the UK, your statutory rights are unaffected. Subject to that, we are not liable for indirect or consequential loss, or for loss arising from your use of a training plan against the guidance in section 2.
9. Changes
We may update these terms. Material changes will be announced by email or in the app before they take effect; continuing to use CLYMB after that means you accept them.
10. Governing law
These terms are governed by the law of Germany. If you are a consumer, you keep the protection of the mandatory law of your country of residence and may bring proceedings there. We are not obliged, and are not willing, to take part in dispute-resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of § 36 VSBG.
